Some safeguards against PLAGIARISM
---------------------------------------------------
Of late many instances have come to the notice where in contents posted
by the originator were unabashedly posted by unscrupulous elements either in
their own name or posted on their walls/blogs/pages without acknowledging the
source of the material/originator giving a reader an idea that the work belongs
to cheater/thief. Recently works of some
of my friends on Facebook/ (Sunita)
(Shaista) (Menika) / have been posted somewhere else without their permission
and knowledge. These are but a few examples only. It is well known fact that plagiarists are
everywhere. One can not help in these cases unless and until the work concerned
is copyrighted. In that case the offender can be sued and compensation demanded.
However it is not so easy as it seems. It is very cumbersome to get each and
every poem/story/article copyrighted from www.copyright.gov.in every time it is posted. Suing a person is
also not an easy task in our legal system. However if one goes through the FAQs
of the site, one can stumble upon an answer which says, Quote , “Is it necessary to register a work to claim
copyright?
Ans: No. Acquisition of copyright is automatic and it does not require
any formality. Copyright comes into existence as soon as a work is created and
no formality is required to be completed for acquiring copyright. However,
certificate of registration of copyright and the entries made therein serve as
prima facie evidence in a court of law with reference to dispute relating to
ownership of copyright” Unquote.
It is clear that once a work is created its copyright remains with the
originator. However following steps may ensure that your work remains safe even
if plagiarized.
a) Please write COPYRIGHT/ your name or mention All Rights Reserved/your name (date & times is
automatically shown, if not, put it there too)
b) Check often,
through Plagiarism Checker, whether your contents are published/
plagiarized anywhere on the net.
c) If you happen to
know about theft of the content, warn the person concerned and shame him/her on
your wall, on his/her page/wall and also seek the blacklisting/blocking of the
person concerned through your friends.
d) Report him/her to
the service provider/ admins.
e) After every three months please do post the
following on your timeline, page, website etc. :-
Notice
It is brought to the notice of everyone
that my thoughts, writes, poems, stories, articles etc, published on facebook
and other websites existing on world wide web are my intellectual property and
entirely belong to me. No part of my writings/sayings be reproduced or
transmitted in any form or by any means viz electronic, mechanical,
photocoping, recording or otherwise without my express permission and consent.

These steps are also not full proof yet it may prove to be detterent to
a plagiarist. He/she may have to think twice before she steals the content.
I must mention here that ideas/concepts have no copyrights. Any one can
develop already existing idea/concept in his/her own style and language except
works of art which is to be patented.
I hope this information may help poets/writers to some extent.

Thanks for writing the post , sir. As these days violation ofthe copyright acts become so common that we heard some terrifying news everyday from many people. Few days ago, I saw a post circulated on Facebook by a writer that her whole book has been printed in the form of a novel, but thewriter is someone else. And, the writer is the one who once worked as the editor in the same publication house, where she had sent her draft to be noticed. This post circulated a lot, but never heard about the outcome next. Similar scenario happened, when a professor of Patna University claimed Chetan Bhagat ' Half Girlfriend' as his own work, but Chetan Bhagat just recalled it as a cheap publicity stunt. The case is still in
ReplyDeletethe Patna high court. Every single one is supposed to be inspired from the people they used to read- but violation sucks Sometimes it become tidy, Whom to believe or whom not. Big names, or the people who are working undergrounds, cheated and then later betrayed publicly. Writers are supposed to penned down their beliefs, their ideas without any prior stress. But these days violation of writing ethics is the one major concern, and such cheap things are earning bad name to the pious profession of writing.
If Kalidasa was alive today, he must suffered from these things
Thanks for writing such a nice colomn, sir.
Thank you Krb Saurabh. It is just to enlighten budding poets and writers. Plagiarists are every where. One may not know that his/her work is being translated in other languages too. One sincerely prays that it does not happen yet there is no control. Happy reading and writing.
ReplyDeleteThank you TB for this important info.Film people are the worst offenders; be wary of them.
ReplyDeleteThank you dear Manohar. Yes I am aware of it.
